Terms and Conditions

Our hosting services may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to: copyrighted material, trademarks, trade secrets, or other intellectual property rights used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Pirated software, hacker programs or archives, warez sites, unauthorized distribution of copyrighted media, and IRC bots are not allowed by our hosting services. The Client agrees to indemnify and hold harmless Atomic Hosting from any claims resulting from the use of the service that damages the Client or any other party.

Atomic Hosting will be the sole arbiter as to what constitutes a violation of this provision.

IRC and Bot Services

Atomic Hosting does not allow IRC (Internet Relay Chat), IRC bots, or similar chat relay services to be operated on our servers due to resource consumption and security concerns.

Adult Content

Atomic Hosting does not allow adult-oriented sites including pornography, sex-related merchandising, or links to adult content elsewhere.

Security

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include, but are not limited to the following: unauthorized access, use, probe, or scan of a system’s security or authentication measures; interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, and broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Server Resources

Any excessive server usage (such as, but not limited to, CPU time, memory usage, disk space, and network bandwidth) is strictly prohibited. Any site which has a negative impact on server performance or other clients may be suspended without notice. Clients are expected to optimize their applications and databases for efficient resource usage.

Shell Access and SSH

Note: SSH access is currently not available. We will notify clients when this service becomes available.

Chat Rooms and Real-Time Applications

We do not allow clients to install traditional chat room applications. Chat rooms and similar real-time applications tend to use an unusually large amount of system resources. Clients requiring chat functionality should consider modern alternatives such as third-party chat services or contact us to discuss enterprise solutions.

Scheduled Tasks and Background Processes

We may allow cron jobs and programs to run in the background. These programs will be considered on an individual basis based on system resources used. If you wish to run background programs, please contact us with details about the program, frequency, and expected resource usage.

Unsolicited Commercial Email – SPAM – Bulk Messaging

Spamming, or the sending of mass unsolicited emails, is strictly prohibited. This includes but is not limited to: bulk email campaigns without explicit opt-in consent, email harvesting, use of purchased email lists, and any messaging that violates CAN-SPAM Act regulations or similar international laws. We will be the sole arbiter as to what constitutes a violation. Violations may result in immediate account suspension.

Billing and Payment

Payment is accepted via credit card, debit card, and other electronic payment methods. We will automatically bill your payment method for the identical account type and period as was previously ordered unless you cancel your account before the renewal date. You are responsible for maintaining current payment information in your account.

Refunds

We offer a 30-day money-back guarantee. If you are not 100% satisfied within the first 30 days of hosting, please contact us for a complete refund. This offer applies to web hosting services only; domain names, SSL certificates, and other add-on services are not included in this offer. Hosting accounts cancelled after this 30-day period will not be refunded. A hosting account that has been suspended due to abuse of resources, policy violations, or other events will not be eligible for refund.

Free and Trial Accounts

For free or trial hosting accounts, we reserve the right to suspend or terminate these accounts at any time for any reason, including but not limited to resource abuse, inactivity, or business decisions. Free accounts may have additional restrictions as outlined in the specific service terms.

Modifications to Terms

This Acceptable Use Policy may be amended at any time, at the discretion of Atomic Hosting. We will make reasonable efforts to notify clients of significant changes via email or account notifications. All accounts are required to comply with any changes made to these policies. Continued use of our services after policy changes constitutes acceptance of the updated terms.

Agreement and Acceptance

In order to maintain a high quality of service, all sites and web hosting plans are subject to the terms and conditions of the Atomic Hosting Acceptable Use Policy. Sites can be cancelled without refund, and Clients and/or their agents may be subject to legal prosecution if found in violation. Placing an order and subsequent submission to a server of website data, including files, images, and text, are proof of the Client’s agreement and acceptance of the terms and conditions of the Acceptable Use Policy. Clients agree they have read and understood the terms and conditions of the Acceptable Use Policy before ordering any plan.
